INVENTORY OF PARTNERSHIP ASSETS :
Announcements on the day of the sale take precedence over all others. All items are being sold at absolute public auction. A 10% buyer’s premium is in effect for all items sold at this auction and paid for by cash or by good check. A 15% buyer’s premium is in effect for all items sold at this auction and paid for by verified credit card. All items are being sold “AS IS, WHERE IS” and “WITH ALL FAULTS.” The auctioneer, the seller, the partners in Tuff-Enuff Safe Outlet and all of their respective agents, employees, attorneys, accountants, legal representatives, personal representatives and assigns (the “Selling Parties”) have made NO WARRANTIES AND/OR REPRESENTATIONS, EITHER EXPRESS OR IMPLIED, that relate, in any manner, to the items being sold here today. The buyers of such items accept the same in the item’s current and present condition. All items must be paid for today by cash, good check or verified credit card. Except as otherwise noted, any items paid for by cash, good check or verified credit card must be removed on the date of sale. Notwithstanding any provision contained herein to the contrary, if payment for the Cargo Express 16 Ft. Safe Trailer or the 2001 Ford F-350 w/Tommy Lift is made by check, then such item (or items) shall be retained at the sale location until such time that the Auctioneer can verify that the check received has cleared the bank and that good funds are available. Once this verification is made, the Auctioneer will make arrangements for the buyer to pick up and take possession of his/her/its item (or items) at the sale location within a reasonable period of time, not to exceed ten (10) days from the date that the buyer is contacted to remove the item(s). Buyer is solely responsible for removing the purchased items from the sale location. Buyer shall forever indemnify and hold the Selling Parties, the owner of the real property at which the sale is held and all other interested parties (“Indemnified Parties”) harmless from all claims and liabilities associated with removing the purchased items. Buyer shall remove the purchased items at Buyer’s own risk and waives all claims against the Indemnified Parties arising in relation thereto. Buyer acknowledges that this agreement is being made and entered into in Carter County, Tennessee and that the laws of the State of Tennessee govern this agreement. Any dispute, claim and/or cause of action arising in relation to this agreement and/or buyer’s participation in this auction sale may only be asserted in a state court of competent subject matter jurisdiction located in Carter County, Tennessee. Auctioneer expressly reserves the right to reject any bid(s) not considered to be in the best interest of the sale and/or the Seller. By attending, registering as a bidder for and/or participating in the auction, Buyer expressly agrees to the terms, conditions and provisions set forth herein. |
