Terms: A 10% buyer’s premium is in effect for all items of personal property sold at this auction.

Unless otherwise noted, all personal property (including, without limitation, the farm equipment) shall be sold at absolute auction. The 2007 Chevrolet Corvette is being sold subject to Seller’s confirmation. Certain other items may be subject to Seller’s confirmation and such items shall be noted during the sale.

The personal property is being sold “AS IS, WHERE IS” and “WITH ALL FAULTS.” The Auctioneer, the Sellers and their respective agents, employees, attorneys, legal representatives, personal representatives and assigns (the “Selling Parties”) have made NO WARRANTIES AND/OR REPRESENTATIONS, EITHER EXPRESS OR IMPLIED, that relate, in any manner, to the personal property being sold here today. The buyers of such personal property accept the same in its present and current condition.

All items must be paid for today with cash or good check. If any buyer purchases items for a total amount of less than $1,000.00 (whether by cash or by good check), such items shall be removed on the day of the sale.

If any one buyer purchases one or more items for a total amount of more than $1,000.00 and if such buyer pays by check, then good funds must be verified before the buyer may remove his/her items from the sale location and before title will issue. Upon verification of good funds, the buyer shall be contacted to remove his/her items from the sale location and such items must be removed within a reasonable period of time, not to exceed ten (10) days from the date that buyer is contacted to remove the items. If any such buyer pays by cash, the buyer shall remove his/her items on the day of sale.

Buyer is solely responsible for removing the purchased items from the sale location. Buyer shall indemnify and hold the Selling Parties harmless from all claims and liabilities associated with removing the purchased items. Buyer shall remove the purchased items at buyer’s own risk and waives all claims against the Selling Parties, the warehouse owner and others arising in relation thereto.

Buyer acknowledges that this agreement is being made and entered into in Washington County, Tennessee and that the laws of the State of Tennessee govern this agreement. Any dispute, claim and/or cause of action arising in relation to this agreement and/or buyer’s participation in this auction sale may only be asserted in a state court of competent subject matter jurisdiction located in Washington County, Tennessee.

Auctioneer expressly reserves the right to reject any bid(s) not considered to be in the best interest of the sale and/or the Sellers.
